Understanding CDSCO for Cosmetic regulations in India

The Central Drugs Standard Control Organization (CDSCO) is India's national regulatory body responsible for regulating pharmaceuticals, medical devices, and cosmetics.  Under the purview of the Drugs and Cosmetics Act, 1940, and its corresponding rules, CDSCO oversees the manufacturing, import, distribution, and sale of cosmetics in the country. The State Drugs Controller and the State Licensing Authority (SLA) is responsible for overseeing the manufacture for sale or distribution of all categories of cosmetics; sale, stock, exhibit or offer for sale or distribution of all categories of cosmetics and grant of approval to the laboratory which applies for carrying out tests on cosmetics and their raw materials.

Key Requirements for CDSCO Manufacturing License for Cosmetics in India

Manufacturers must prioritize the employment of proficient technical personnel to oversee all manufacturing operations, ensuring precision and adherence to quality standards. It is imperative to furnish exhaustive information concerning the formulation of each cosmetic product intended for production, promoting transparency and regulatory compliance. Cosmetic Manufacturing Facility Compliance for Cosmetics in India

The manufacturing facility must comply with Schedule VII of the Cosmetics Rules, 2020. The applicant must provide a self-declaration using Form COS-7, confirming compliance with Good Manufacturing Practices and the requirements for premises, plants, and equipment specified in the Seventh Schedule. Within thirty days of license or loan license issuance, the State Licensing Authority or a designated subordinate officer inspects the site to verify the information provided in the self-declaration Form COS-7. Every licensed manufacturing facility undergoes inspection at least once every three years.

CDSCO Manufacturing License for Cosmetics in India

The application for a manufacturing license is submitted using Form COS-5. Following a comprehensive assessment by CDSCO, a manufacturing license for cosmetics production is issued under COS-8. The State Licensing Authority is mandated to grant a Manufacturing License or loan license within forty-five days from the date of application after scrutinizing the submitted application and documents.

If the manufacturer does not possess their own manufacturing facility and instead utilizes premises owned by others, they may apply for a Loan license using Form COS-6. The issuance of the loan license is conducted under Form COS-9 by the State Licensing Authority after thorough assessment. Similar to the standard manufacturing license process, the State Licensing Authority is required to grant a Loan License within forty-five days from the date of application after scrutinizing the submitted documents. 

Application Process For Obtaining Manufacturing License For Cosmetics In India

  • Application Submission: Prepare and submit the CDSCO manufacturing license application along with requisite documents and fees through the SUGAM Portal. If the cosmetics are manufactured at more than one premises, a separate application for each of such premises shall be made and a separate license obtained for each such premises.

  • Inspection: CDSCO may conduct an inspection of the manufacturing facility to assess compliance with GMP standards.

  • Review and Approval: Upon successful completion of the inspection and verification of documents, CDSCO will review the application and grant the manufacturing license.

  • Compliance and Renewal: Once granted, the CDSCO manufacturing license is valid for a specified period, typically five years. Manufacturers must ensure ongoing compliance with regulatory requirements and may need to undergo periodic inspections by CDSCO. Timely renewal of the manufacturing license is essential to maintain legal authorization for production.

Conditions for Obtaining CDSCO Manufacturing License For Cosmetics In India

After obtaining approval for the manufacturing license, the manufacturer is obligated to uphold compliance with the requirements set forth by the Central Drugs Standard Control Organization (CDSCO). The CDSCO has implemented rigorous criteria for securing a manufacturing license.

  • Educational Qualifications: The manufacturer must meet one of the following criteria:

    • Hold a Diploma in Pharmacy approved by the Pharmacy Council of India under the Pharmacy Act, 1948.

    • Be registered under the Pharmacy Act, 1948.

    • Have passed the Intermediate Examination with Chemistry as one of the subjects, or an equivalent examination recognized by the Licensing Authority.

    • Hold a bachelor's degree in Cosmetic Technology from a recognized university.

  • Compliance with Factory Premises Requirements: The factory premises must comply with the specifications outlined in the Seventh Schedule.

  • Laboratory Facilities: The manufacturer must either:

    • Provide and maintain adequate staff, premises, and laboratory equipment for testing the cosmetics and raw materials.

    • Make arrangements with a laboratory approved by the Central Licensing Authority and accredited by the National Accreditation Board for Testing & Calibration Laboratories (NABL) for conducting tests.

  • Documentary Evidence: The applicant must maintain documentary evidence related to premises ownership or occupation, firm constitution, and any other documents required for verification by the Licensing Authority.

  • Compliance with Regulations: The licensee must adhere to the provisions of the Act and the rules made thereunder, along with any further requirements specified in future rules under Chapter IV of the Act.

  • Record Keeping: Detailed records of each batch of cosmetics manufactured and raw materials used must be maintained as per the particulars specified in the Eighth Schedule, retained for a period of three years after batch expiry.

  • Inspection and Sampling: The licensee must allow inspectors to enter the premises, inspect products, take samples, and access all registers and records as per the Act and rules.

  • Notification of Changes: Any changes in labeling, composition, testing, specifications, or documentation of cosmetics must be promptly reported to the Licensing Authority.

  • Change in Constitution or Address: Any change in the constitution of the firm or manufacturer's name or address must be communicated to the Licensing Authority within specified timeframes.

  • Amendment Application: In case of changes in the name or address of the manufacturer, an application for amendment must be submitted to the state Government for prior approval from the Licensing authorities within sixty days.

The fee structure applies to each cosmetic category and manufacturing site, with additional fees for each specified category of cosmetic and variant.
